What Is an LMIA Work Visa in Canada?



LMIA stands for Labour Market Impact Assessment. It is an assessment carried out by Employment and Social Development Canada (ESDC) to determine the potential effect of hiring a foreign worker on Canada's labour market.



An LMIA is normally obtained by the Canadian employer, rather than the foreign worker.



If an employer needs an LMIA and receives a positive decision, the employer provides the worker with the relevant LMIA documentation. The worker can then apply to Immigration, Refugees and Citizenship Canada (IRCC) for a work permit.



For a typical LMIA-based work permit application, the worker may need:



A valid job offer

Employment contract

Copy of the positive LMIA

LMIA number

Other documents required for the work permit application



It is important to understand that an LMIA is not itself a work permit or visa. The LMIA is part of the employer's process, while the foreign worker must separately apply for the appropriate Canadian work permit.



How Does the LMIA Work Visa Canada Process Work?



The process generally involves both the Canadian employer and the foreign worker.



Step 1: Find a Genuine Canadian Job Offer



The first step is obtaining a legitimate job offer from a Canadian employer.



The position must meet the applicable requirements of the Temporary Foreign Worker Program (TFWP), and the employer must demonstrate that the business and employment opportunity are genuine.



Canadian authorities assess factors such as whether the employer is actively operating a business, whether there is a genuine employment need, and whether the employer can fulfill the terms of the job offer.



Step 2: Employer Applies for an LMIA



Where an LMIA is required, the Canadian employer submits an application to ESDC/Service Canada.



The employer may need to demonstrate recruitment efforts to show that reasonable attempts were made to hire Canadian citizens or permanent residents before seeking a foreign worker.



The exact requirements depend on the occupation, wage level, province or territory, and LMIA stream.



Step 3: Receive a Positive LMIA



If the application is approved, the employer receives a positive LMIA decision.



The employer then provides the relevant documentation to the foreign worker so that the worker can proceed with the work permit application.



Step 4: Apply for a Canadian Work Permit



After receiving the required employer documents, the foreign worker submits a work permit application to IRCC.



The application can require supporting documents relating to the applicant's identity, employment, qualifications, work experience, finances and admissibility, depending on the circumstances.



Step 5: Receive the Work Permit Decision



If IRCC approves the application, the applicant can receive authorization to work in Canada according to the conditions and validity period of the work permit.



The duration of the work permit is not automatically the same as the LMIA validity period. IRCC determines the work permit validity based on the applicable rules and the circumstances of the application.



Who Needs an LMIA to Work in Canada?



Many Canadian employers need an LMIA before hiring a temporary foreign worker through the Temporary Foreign Worker Program.



However, not every Canadian work permit requires an LMIA.



Some workers may qualify under the International Mobility Program or another LMIA-exempt category. For example, certain situations involving international agreements, intra-company transfers or other exemptions may allow a worker to obtain a work permit without an LMIA.
